Just got a call from our elder care attorney. It seemed to take a long time for our trust to be evaluated so that an update of the DPOA etc could be made. Well here is the reason and hold on to your hats! We did our trust in 1991. The attorney who did that had no problems, no suspensions etc. He just retired and turned his clients to another attorney. However, when our estate attorney got into our trust, I got a call last week saying it was more complex than originally thought. Today's conversation required just one or two clarifications on our part. Then the big news..the attorney who did our two reviews, the last one in 2008 has a history...and has been disbarred in well the late 90s........
It now makes sense when I first called to find out some things about the trust now the DH has this DX only to be told he is quite ill. I got no further communication just bounced email saying he was not able to chat..
When I looked up this man's case seems he had family crisis excuses for not meeting his obligations to clients..anyway...when finding a lawyer, even if a lawyer is recommended by another attorney, check further into him or her. And look for the Martindale-Hubble ratings.
I have a brother who is an attorney and he checked out our current attorney but I wish I had asked him to look into the first one. If he did he never told me what he found out.
I think we are going to be ok in the end here..( told hubby we are not going anywhere or take any chances until our trust is worked out..got to keep CA probate far away from us).

Oh, asked her about the utilities billing which is a topic on another thread. Our attorney said even if there are no illnesses it is a good idea to have both names on the bills..if one gets it in an accident then we would have the same headaches..so..kiddies..heads up..more on the to do lists.
